Please read these Terms of Service (“Terms”) carefully before using the Obscura Flux website (“the Site”) operated by Obscura Flux, located at 1-1 Chiyoda, Chiyoda City, Tokyo 100-0001, Japan. By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Site.

1. Acceptance of Terms

Your access to and use of the Site is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors and other persons who access or use the Site. By continuing to use the Site, you confirm that you are at least 18 years of age, or that you are the parent or guardian of a minor using the Site with your permission.

2. Use of the Site

You may use the Site for lawful, personal, and non-commercial purposes only. In using the Site, you agree that you will not:

You are granted a limited, non-exclusive, non-transferable licence to access and view the content on the Site for personal, non-commercial purposes. You may not reproduce, distribute, create derivative works from, publicly display, or commercially exploit any content without our express prior written consent.

Any feedback, comments, or suggestions you voluntarily provide regarding the Site may be used by us without restriction and without any obligation to you.

4. Tour Bookings and Services

Information about guided tours and bespoke historical services provided on the Site is for enquiry purposes only. Tour enquiries submitted by telephone or email are subject to separate booking terms and conditions, which will be provided to you at the time of your enquiry.

Availability of tours is not guaranteed and no booking is confirmed until you have received written confirmation from Obscura Flux. We reserve the right to decline any booking at our discretion.

Prices listed on the Site are indicative and subject to change without notice. Final pricing, including applicable taxes and any additional fees, will be communicated and confirmed with you in writing during the booking process.

We reserve the right to cancel or modify tour itineraries in the event of circumstances beyond our reasonable control, including but not limited to extreme weather, public health emergencies, or closure of historical sites by relevant authorities. In such circumstances, we will endeavour to offer an alternative date or a refund of any amounts paid.

5. Accuracy of Information

The historical information and commentary published on the Site is based on research conducted by our team and contributors. While we endeavour to ensure the accuracy and completeness of this content, we make no warranty or representation that the information is free from error, omission, or inaccuracy. Historical scholarship is subject to ongoing revision, and content on the Site may not reflect the most recent academic findings. We recommend consulting authoritative academic sources for scholarly purposes.

6. Third-Party Links

The Site may contain links to third-party websites or resources. Such links are provided for your convenience only. We have no control over the content, privacy practices, or availability of those external sites and resources, and we accept no responsibility for them. We do not warrant that the Site will operate without interruption or error, that defects will be corrected, or that the Site or the servers that make it available are free of harmful components. We do not warrant the accuracy, completeness, or usefulness of any information on the Site.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Obscura Flux, its officers, directors, employees, agents, suppliers, and content contributors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, revenue, goodwill, or data, arising from: (a) your access to or use of, or inability to access or use, the Site; (b) any conduct or content of any third party on or linked to the Site; (c) any content obtained from the Site; or (d) unauthorised access, use, or alteration of your transmissions or content.

In no event shall our total aggregate liability to you for all claims arising out of or related to your use of the Site exceed the amount, if any, paid by you to Obscura Flux in the twelve (12) months preceding the relevant claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless Obscura Flux and its officers, directors, employees, agents, and successors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, and legal fees arising out of or relating to your breach of these Terms, your use of the Site, or your violation of any law or the rights of a third party.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Japan, without regard to any conflict of law principles. Any dispute arising in connection with these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the Tokyo District Court, Tokyo, Japan.

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms shall otherwise remain in full force and effect.

11. Changes to These Terms

We reserve the right to amend these Terms at any time. Changes will take effect immediately upon posting to the Site, with the “Last updated” date revised accordingly. Your continued use of the Site following the posting of revised Terms constitutes your acceptance of those changes. We recommend reviewing these Terms periodically.
